1. Services and Payment

1.1 Training Packages:
The studio offers various training packages tailored to different fitness needs, including packages of 1, 3, 5, 8, 10, and 20 sessions. Detailed package descriptions, validity periods, and prices are provided on our website. All packages are personal, non-transferable, and non-refundable unless stated otherwise.

1.2 Membership Payments:
For fixed-term memberships (1, 3, or 12 months), payments are automatically debited monthly from the customer's designated account. Payment is due on the same calendar day as the contract start date. If the date does not exist in a particular month, payment will be processed on the last day of the month.

1.3 Contract Renewal and Cancellation:
Memberships renew automatically for the original term unless canceled on time:

• 1-month memberships: cancellation must be submitted at least 1 calendar day before expiry.

• 3- and 12-month memberships: at least 30 calendar days prior to expiry.

Late cancellations result in automatic renewal. Refunds for missed deadlines are excluded.

1.4 No Withdrawal After First Use:
Once the first training session has been attended, the statutory right of withdrawal (Rücktrittsrecht) is waived under § 18 Abs. 1 Z 11 FAGG.

1.5 Payment Defaults:
If a payment fails or is revoked, the customer is obligated to cover any resulting bank fees or collection costs. The studio reserves the right to suspend access until the outstanding balance is settled.

2. Cancellation Policy

2.1 Customer Cancellations:
Early cancellation of fixed-term memberships is only accepted under the following conditions:

• Serious medical condition (with certified medical documentation);

• Permanent relocation (with official documentation);

• Other significant circumstances may be considered upon written request at the discretion of management.

2.2 Studio Cancellations:
The studio reserves the right to terminate a contract with immediate effect for serious reasons, such as:

• Violation of studio rules;

• Repeated payment failures;

• Aggressive, harassing, or unsafe behavior.

Affected clients will be notified in writing. In such cases, refunds are excluded.

3. Training Terms

3.1 Booking and Cancellation of Sessions:
All sessions must be booked in advance. Cancellations must be made at least 6 hours prior to class. Late cancellations:

• Annual members: €10 penalty fee per missed session;

• Non-members: forfeiture of the session without refund.

Repeated no-shows or unpaid penalties may result in membership suspension.

3.2 Missed Sessions:
Clients are responsible for attending their scheduled sessions. Missed sessions are not refundable.

3.3 Non-Transferability:
All sessions and memberships are strictly personal and cannot be transferred.

3.4 Expiry of Sessions:
All sessions and packages expire according to the timeframe stated at purchase. Extensions are only possible with a medical certificate confirming inability to train for a defined period.

3.5 Conduct:
The studio reserves the right to deny access or suspend clients who engage in disrespectful, discriminatory, aggressive, or disruptive behavior. No refunds will be issued in such cases.

3.6 Safety:
Clients must follow trainer instructions and use equipment responsibly. Any injuries must be reported immediately. The studio reserves the right to deny participation to clients who pose a safety risk to themselves or others.

4. Studio Rules and Liability

4.1 Health Confirmation:
By participating, clients confirm they are physically fit and have consulted a physician if necessary. Training is at one’s own risk.

4.2 Liability Disclaimer:
While the studio takes all reasonable precautions, it is not liable for injuries, health complications, or accidents. Clients are liable for damage they cause to equipment or premises.

4.3 Lost or Stolen Property:
The studio accepts no liability for lost, stolen, or damaged personal belongings.

5. Data Protection

5.1 GDPR Compliance:
Personal data is processed in accordance with the General Data Protection Regulation (GDPR). A full privacy policy is available on our website.

5.2 Consent:
By signing up, clients consent to the processing of their personal data for contract execution, communication, and studio operations. Clients have the right to access, correct, or delete their data.

6. General Provisions

6.1 Applicable Law:
These terms are governed by Austrian law. Place of jurisdiction is Vienna.

6.2 Amendments:
The studio reserves the right to update these terms with 30 days' notice. Continued use of services implies acceptance.

6.3 Language:
In the event of interpretation differences, the German version of these terms shall prevail.

6.4 Severability Clause:
If any provision is deemed invalid, the remaining provisions shall remain in full force.

7. Acknowledgement

7.1 Acceptance:
By registering, booking, or purchasing any training package, the client confirms having read, understood, and accepted these Terms of Use.
