1. Services and Payment
1.1 Training Packages:
The studio offers a variety of training packages tailored to different fitness needs, including options for 1, 3, 5, 8, 10, and 20 sessions. Detailed descriptions of each package can be found on our website.
1.2 Membership Payments:
For fixed-term memberships (1, 3, or 12 months), payments are automatically debited monthly from the customer’s specified account on the same day of the month as the original contract start date. For example, if the contract begins on May 5, payments will be due on the 5th of each following month. If that day does not exist in a given month (e.g., 31st), payment will be processed on the last calendar day of that month.
1.3 Contract Renewal and Cancellation Deadlines:
Memberships automatically renew for the originally agreed period unless canceled on time:
1-month memberships must be canceled at least 1 calendar day before the end of the term.
3- and 12-month memberships must be canceled at least 30 calendar days before the end of the term.
If the cancellation is not submitted on time, the contract will renew automatically for the same duration. No refunds will be issued for late cancellations.
1.4 No Right of Withdrawal After First Use:
Once the first training session has taken place, the right of withdrawal is voided. This protects the studio from misuse.
2. Cancellation Policy
2.1 Customer Cancellations:
Customers with yearly memberships may cancel before the end date under the following conditions:
Medical unfitness, confirmed with a doctor’s note.
Relocation to a different city, confirmed with official documentation.
Other major life events may be considered on a case-by-case basis with approval from studio management.
2.2 Studio Cancellations:
The studio reserves the right to terminate a contract for reasons such as violation of studio rules, repeated non-payment, or disruptive behavior. Affected clients will be informed at least one month in advance.
3. Training Terms
3.1 Booking and Cancellation of Sessions:
Sessions must be booked in advance. Cancellations must be made at least 6 hours before the scheduled session. Otherwise, a penalty of €10 applies for membership holders. Failure to pay this fee may result in suspension of membership rights. Non-members will lose the credit for the missed session without refund.
3.2 Missed Sessions:
The trainer is not responsible for missed sessions. It is the client’s responsibility to attend scheduled sessions.
3.3 Non-transferability:
Training sessions are personal and non-transferable to others.
3.4 Expiry of Sessions:
Unused sessions expire at the end of the membership unless extended due to a long-term illness documented by a physician or other exceptional, pre-approved circumstances.
3.5 Conduct in the Studio:
The studio reserves the right to suspend clients for disrespectful behavior, harassment, or violation of studio rules. In such cases, no refund will be issued.
3.6 Validity of Session Blocks (Non-Memberships):
Each session block (e.g. 5, 10, 20 sessions), not associated with a membership, has a clearly defined validity period stated on the website prior to purchase. It is the client’s responsibility to monitor the expiration date and number of remaining sessions.
The only acceptable reason for extending the validity of a session block is a doctor’s certificate clearly stating that the client was unable to participate in physical activities during a specific period. In all other cases, the unused sessions expire without refund or transfer.
4. Studio Rules
4.1 Health & Safety:
By participating in sessions, the client confirms they are in good physical condition and have consulted with a physician regarding their ability to engage in physical activity.
4.2 Liability:
While we take every precaution to ensure safety, the studio is not liable for injuries or health issues resulting from training. Clients are responsible for any damage they cause to studio equipment or property and will be liable for repairs or replacements.
4.3 Lost or Stolen Property:
The studio assumes no liability for lost or stolen personal items. We recommend keeping valuables with you at all times.
5. Data Privacy
5.1 Data Protection:
We are committed to protecting your personal data. All data collected during registration and throughout your membership is processed in accordance with the General Data Protection Regulation (GDPR). Further details are available upon request.
6. General Terms
6.1 Governing Law:
These terms are subject to Austrian law.
6.2 Changes to Terms:
The studio may update these terms with at least 30 days' notice. Continued use of our services constitutes acceptance of the updated terms.
6.3 Language:
In case of discrepancies between different language versions of these terms, the German version shall be legally binding.
7. Final Provision
7.1 Acceptance of Terms:
By registering or purchasing a membership or training package at The Jungle, the client confirms they have read, understood, and accepted these terms and conditions.
